I need a clear headed opinion because I'm getting too irritated to think clearly. I've got this 50 Dodge parts car that I've stripped for everything I want and was ready to sell it. Some guy called me and drove a fairly long distance to look at it and paid me for it. I told him I wanted it gone in two weeks because I need the garage space. That's the last I heard of him and it's coming up on a month. I keep trying to call the only number I have for him and it goes straight to voicemail but he never returned any calls. I'm getting close to reselling it and giving him his money back if he ever calls. I dont want to screw anyone over but the irritation level is rising everytime I look at this trhing taking up my garage space. How much time should I give him in order to be fair?

Send him a letter and spell out the particulars about failing to live up to his end of the bargain. Then give him a final date to have it removed. If he has not picked it up by then, re-advertise it. Be prepared to refund his money.

Like Lynn says only in this case I would consider a certified letter so that if you wind up in court you have something to help prove your case.

That's part of the problem; no address. I don't even know the guy's last name. He just came over, paid cash, left me a cell phone number, and said he'd be back that weekend. I've been leaving a voice mail daily for two weeks but nothing so far.

Shove it outside. Now you have your garage space. If the neighbors complain, put a cover on it.

....or leave him a phone message that you will start charging storage! He will show up then!

There was a case on the Peoples Court where a husband was trying to get his ex-wife to pick-up the satellite dish she won in the divorce. He called her 3 times to no avail. He put it outside by the railroad tracks and it disappeared. She sued him for the cost of the dish but the judge said, too bad. You should have picked it up when you won your judgement. Your lucky he doesn't charge you storage fees.

Check with your local court. Around here, they have one day a week for free legal advise. Seems that notifying the guy via phone would suffice, but keep the phone bill to show you called him. Then push the car onto the street. If it's towed, called him and tell him where he can claim his car.

Like HOTRODPAINT said, shove it outside and get your space back. Explain to the neighbors that the car is up for sale and will be gone soon.

This guy is either dead, in jail or in the hospital. Re-sell the car and hold onto the money he gave you for it, along with a copy of this thread.

Thanks for all the good feedback; I guess i'll leave him another message with a deadline and offer to mail his money back if he just wants to leave his address on my voicemail. I hate to do that to the guy; he seemed pretty decent. I'd shove it outside but it no longer rolls; he was going to winch it onto a trailer. I'll give him two more weeks before I do something.

Can you do a reverse search with his phone number to find his name??

I didn't know you could do that on a cell phone number; i'll give it a try.

It was a good try; all it tells me is that it's a Verizon cell phone number out of Springfield, Ill.

Wait two week,s then resell it and be ready to refund the money; is awfully nice. I don't think you can do much better than that.

A lot of people would just resell it and tell him to suck rocks if he ever shows back up.

Well, I tried every method known to man to trace this guy with no luck. I called Verizon to trace the cell # for me and they refused. They did verify that the number was in operation and that it was based out of Springfield, Ill. I left him a message that he had until the 10th to contact me for a pickup or refund and then it goes back on Ebay. I told him once it goes back on Ebay, i will still gladly refund his money, all he has to do is call me with an address and I'll send it to him. The 10th came and went, so i put it back on the auction this morning. Still no contact. I dont think I can be any more fair about it.

I'd say you tried more then enough... IMO he's the one with the problem...

Dollars to doughnuts, he has a bench warrant out on him and he's laying low. Keeping the cell intact allowing him to stay in contact with those who can keep him posted. Verizon doesn't give him up and he knows this. You did well and all you can do has been done.
